Environmental Expert Witnesses

Environmental disputes carry exposure that can outlast the transaction or operation that created them. Responsibility for contaminated property is contested among current and former owners, operators, lenders, and insurers; industrial facilities face enforcement over air, water, and waste permits; and corporations increasingly defend securities and consumer-protection claims based on their environmental and ESG disclosures. Environmental conditions also drive commercial valuation disputes, from diminished property value to indemnity claims under purchase agreements. The central issue is typically what condition exists, how and when it arose, who is responsible for it under statute or contract, and what it will reasonably cost to address.

An environmental expert helps counsel answer those questions from the evidence rather than from assumption. The analysis often begins with site assessments, sampling data, historical operations records, and regulatory files, then applies fate-and-transport, exposure, or forensic chemistry methods to determine the source, timing, and extent of contamination. That work supports allocation among potentially responsible parties under CERCLA, compliance opinions under RCRA and the Clean Air Act, and evaluation of whether a party met environmental due diligence and permitting standards. Economists and appraisers can then translate those findings into remediation cost, penalty, and property-value analyses that bear directly on damages. Throughout, a careful expert can identify gaps in an opposing party's sampling program or model that weaken its conclusions.
