One manufacturer retained a hydrology expert specializing in contaminant transport to reconstruct the plume's migration pathway using historical groundwater flow direction, contaminant concentration gradients, and the timing of each facility's documented releases. The expert determined that groundwater flow direction had reversed seasonally in a way that explained cross-contamination in both directions, but that concentration gradients pointed to one facility's underground storage tank system as the dominant source, accounting for roughly two-thirds of the plume's mass. That allocation became the basis for a cost-sharing agreement closely tracking the expert's percentages.

A hydroelectric power company sued the operator of an upstream reservoir, alleging that changes to the reservoir's release schedule during a multi-year drought had reduced flows to the company's downstream generating station below what its water rights entitled it to receive, resulting in significant lost generation revenue. The reservoir operator retained a hydrology expert with experience in reservoir operations and water rights administration to reconstruct the reservoir's inflow, storage, and release records against the operating agreement's minimum flow requirements. The expert found releases had in fact met or exceeded the agreement's minimum flow schedule on all but a handful of days, and that the shortfall was better explained by a multi-year decline in the reservoir's natural inflow than by any change in release practices. That reconstruction undermined the power company's core theory of liability and led to a significantly reduced settlement.

A regional agricultural landowners' association sued a pipeline company after temporary dewatering wells installed during a multi-mile pipeline project caused a cluster of nearby irrigation wells to run dry during the growing season, with the association claiming significant damages in lost crop production. A manufacturing company and its property insurer disputed coverage for a warehouse flooding event, with the insurer denying the claim on the theory that the damage resulted from excluded surface water flooding rather than covered internal drainage system failure — a distinction that determined whether the loss was covered at all. The manufacturer retained a hydrology expert to analyze rainfall records, site topography, and the timing and pattern of water intrusion documented in maintenance logs and photographs. A ski resort operator and a downstream water utility disputed the resort's proposed transfer of water rights to expand snowmaking capacity, with the utility arguing the transfer would reduce late-season streamflow below the amount needed to meet its municipal supply obligations, a dispute with significant implications for the utility's annual water deliveries. The resort retained a hydrology expert to analyze decades of historical streamflow gauge data and model the incremental effect of the proposed diversion on downstream flows during the critical late-season period. The expert found the resort's proposed diversion, timed primarily to early winter months, overlapped only marginally with the period the utility identified as critical, and that projected flow reductions during that window amounted to roughly 2 percent of the utility's average intake.
