A large pharmaceutical company paid a substantial sum to acquire a clinical-stage oncology biotech, then sued the sellers after discovering the objective response rate figures presented for the lead antibody-drug conjugate during diligence had been calculated using an interim, unconfirmed set of tumor assessments rather than the confirmed responses required under standard oncology trial methodology. A medical oncology expert reviewed the underlying scan data and response confirmation records behind the diligence summary. The expert found that when confirmed responses were properly applied, the objective response rate dropped by close to a third from what had been represented, with several "responses" never having received the follow-up scan required to confirm durability. That finding was central to defeating the sellers' motion to dismiss and anchored the damages theory used in the eventual settlement.

R&D collaboration milestone dispute over trial endpoints

A biotech sued its large pharma partner for withholding a substantial milestone payment tied to a co-developed checkpoint inhibitor combination, after the pharma partner determined the pivotal trial had failed to meet its primary endpoint. A medical oncology and clinical trial design expert reanalyzed the trial's overall survival and progression-free survival data against the statistical analysis plan locked before unblinding. The expert found that progression-free survival, the plan's actual pre-specified primary endpoint, had been met, and that the pharma partner's negative determination relied instead on an immature overall survival readout that the protocol treated as a secondary endpoint at that data cut. That reanalysis was decisive in the arbitration panel's ruling ordering payment of the milestone in full.

Central imaging core lab tumor assessment dispute

A trial sponsor sued the independent imaging core lab it had contracted to perform centralized RECIST tumor assessments, alleging systematic measurement errors in the lab's scan reads had produced an artificially low response rate that delayed the drug's regulatory submission by roughly a year. A medical oncology expert with radiologic tumor assessment experience re-reviewed a sample of the disputed scans using the same RECIST criteria specified in the trial protocol. The expert found a meaningful share of the re-reviewed scans had been measured using an outdated lesion selection methodology inconsistent with the protocol's imaging charter, understating tumor shrinkage in a pattern that would predictably suppress the calculated response rate. That finding supported the sponsor's breach of contract claim against the core lab and contributed to a settlement covering a portion of the resulting delay costs.

Companion diagnostic validation dispute

A diagnostics company sued its pharmaceutical partner, alleging the pharma company had modified the biomarker cutoff threshold used in the jointly developed companion diagnostic during the pivotal trial without revalidating the change, jeopardizing the diagnostic's own regulatory pathway. A medical oncology and biomarker expert compared the validated cutoff threshold in the collaboration agreement against the threshold actually applied to enroll patients in the pivotal trial. The expert confirmed the enrollment threshold differed from the validated cutoff by a margin large enough to plausibly reclassify a meaningful share of biomarker-negative patients as eligible, a change the pharma partner made without the revalidation the collaboration agreement required. That finding supported the diagnostics company's breach of contract claim and led to a settlement funding a supplemental validation study.

Cell therapy manufacturing potency dispute

A biotech sponsor sued its contract manufacturer after a cluster of CAR-T cell therapy batches for a pivotal trial failed to meet potency release criteria, forcing several enrolled patients to be withdrawn and delaying the trial's completion by several months. A hematology-oncology and cell therapy manufacturing expert reviewed the manufacturer's cell expansion process records and potency assay data against the process parameters specified in the manufacturing agreement. The expert found that a change in the manufacturer's cell activation reagent lot, made without notifying the sponsor, correlated with the drop in T-cell expansion that ultimately caused the failed potency results. A pharmaceutical manufacturer disputed a health plan's demand for rebate clawbacks under an outcomes-based contract for an oncology drug, after the plan calculated that real-world overall survival among its members fell short of the trial-based benchmark the contract used to trigger rebates.
