I was called to testify for a client in which a homeowner was suing my client, a bank, claiming the loan they gave him exceeded what the property value justified. As part of my preparation for court, I located a receipt for the home on file which showed the home’s purchase price was about 90% of the loan amount. Additional research showed that, with the costs of land acquisition and development, the costs to build the same home new far exceeded the loan amount. This evidence combined with the original appraisal supported the loan given. The case was thrown out of court due to this evidence.
