For expert witnesses, the challenge of writing a winning resume is not just passing review by retaining counsel, but also standing up to a more rigorous cross-examination. Opposing counsel will use seemingly simple omissions or mistakes to discredit the expert and challenge her trustworthiness.
In his book, How to Become a Dangerous Expert Witness, Steven Babitsky paints the following discussion between an expert witness and opposing counsel. It demonstrates how a simple omission put the expert's credibility at risk.
"Counsel: That article doesn't appear on your complete and accurate CV, does it?
Expert: My assistant must have forgotten to add that one. I do quite a bit of writing. I'm sorry.
Counsel: Do you know if there's anything else your assistant forgot to add?
Expert: I don't know."
