Professor Dennis Crouch, author of the excellent Patently-O patent law blog, has written an interesting summary detailing a federal court's disqualification of a law firm based in part on an expert witness declaration written by a partner at that firm, in the capacity as an expert witness, in a case in which the firm was representing the other side. The court noted that there was no indication that a conflict waiver had been signed.

Lexis Nexis Survey Details State of the Legal Industry

Lexis Nexis has put out a very comprehensive survey that details the state of the legal industry. The survey polled both corporate counsel and private practice attorneys. The top issue among those cited in the survey was legal pricing/fee structures. For 2010 private practice attorneys note that 60% of their legal fees will be billed in hourly rates. Another interesting finding though suggests that private practice attorneys collectively feel that clients are too focused on reducing cost at the expense of quality legal work. Judge Allows Lawyer to Testify Against Past Employer

A Manhattan judge has allowed a lawyer who worked for Bear Stearns & Co. Inc. for 29 years to testify as a securities expert witness in an arbitration against his former employer. Bear Stearns is being sued by Keefe, Bruyette & Woods Inc., for allegedly overpricing bonds sold by Bear Stearns' hedge funds three years ago. The judge noted that there was no indication that the issues involved in the arbitration were issues about which the expert acquired confidential information. Check out the scoop here.

Attorney Writes on the Billable Hour

D. Michael Grodhaus, an attorney at Waite Bailey Bayless & Chelsey in Columbis, Ohio, has written an excellent article further elaborating on possible future changes to the law firm billable hour. He notes that while there is outside pressure on firms by corporate clients, a real shift away from widespread use of the billable hour may have to come from within law firms themselves. Expert Witness Testimony Limited in Banking Case

A federal judge ruled on Monday that Bank of America, defending a suit by the SEC alleging that it misled investors prior to its acquisition of Merrill Lynch & Co., could not introduce expert witness testimony at trial detailing media reports predicting it would pay bonuses. U.S. District Judge Jed Rakoff found that Bank of America's argument that shareholders already knew that Merrill would likely pay billions of dollars in bonuses based on widespread media reports was not credible because the bank's own proxy statement told shareholders to ignore such reports.

Another Update On The Billable Hour

The Chicago Tribune recently posted an interesting article addressing what has become a fairly hot topics these days, the law firm billable hour. It cites moves by clients such as Kraft, who solicited bids for its body of legal work, and Microsoft, where 45% of its future spending on legal services will be based on "alternative billing arrangements." The article suggest that in the next few years fully 25% of all corporate legal work could be based on some alternative billing arrangement.

Legal Outsourcing Detailed in MCC Interview

An excellent interview in the Metropolitan Corporate Counsel details the growing practice of oustourcing certain non-core work for business and corporate law firms. E-discovery is an area where this is most commonly used. Contract and database management are also two traditional functions being more often handled by a third party servicer.

It is interesting to note that expert witness search firms have been essentially providing outsourcing services for years, performing difficult and time-consuming customized expert witness searches. Accordingly, attorneys can better concetrate on the core functions of his/her case.

Creative Pricing Employed By Many Top Law Firms

An interesting article by legal business consultant Jim Hassett at Legal Business Development Blog notes that many top firms are dramatically lowering rates in an effort to "underbid" other firms for new business. Mr. Hassett learned of the pricing competition when he added a "loss leader" question in an alternative-fee survey of AmLaw 100 firms. Medical Expert Witness Requirements Upheld By Maryland High Court

The Maryland Court of Appeals has upheld a tort reform measure requiring more stringent qualifications for potential expert witnesses in medical liability cases. In 2004, Maryland issued a law that prevented any doctor who devoted more than 20% of their professional time to working on personal injury cases from testifying as a "medical expert." The court has now clarified as to what sort of professional activities may make up the remainder of a doctor's time to qualify. Physicians argue that the move will limit the number of "hired guns" used to push frivolous lawsuits while trial attorneys argue that the rule will limit an injured patient's access to qualified experts.
